1. Introduction & Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of our AI-powered services, including AI product photo generation and image editing, available at https://aiproductphoto.net (the "Service").

By creating an account, subscribing to any plan, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement on behalf of yourself or any organization you represent.

2. Description of Service

2.1 Services We Provide

AIProductPhoto provides an AI-powered platform that enables users to generate and enhance product photography using artificial intelligence. The Service is a digital Software-as-a-Service (SaaS) product delivered over the internet.

2.2 Nature of the Service

The Service is a digital, intangible product. Access is granted immediately upon payment confirmation. Due to the instant-delivery nature of digital services, refunds are subject to specific limitations as detailed in Section 7.

3. Account Registration

3.1 Account Creation

Using the Service requires creating an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

3.2 Account Security

• If you discover unauthorized use, contact our customer service email immediately.
• Do not share your login credentials with any third party.
• Ensure your billing email address remains valid.

3.3 Business Accounts

If registering on behalf of a company or organization, you represent that you are authorized to enter into this agreement on behalf of that entity.

4. Subscription Plans

We offer subscription plans to access the Service. We provide monthly and annual subscription plans (Pro, Ultimate, and Max). Current plan details and pricing are available at https://aiproductphoto.net/pricing.

We reserve the right to modify plan features or introduce new plans at any time. Price changes are subject to Section 5.1.

5. Billing & Payment

5.1 Automatic Renewal Authorization

By providing a payment method and subscribing to a paid plan, you expressly authorize AIProductPhoto to charge the corresponding subscription fee to your payment method on a recurring basis. This recurring authorization remains in effect until you cancel the subscription in accordance with Section 6.

Your subscription automatically renews at the end of each billing cycle unless you cancel. For annual subscriptions, we will send a notification before renewal.

5.2 Taxes

Unless otherwise stated, listed prices do not include applicable taxes (including VAT, GST, sales tax, etc.). Where required by applicable law, we will collect and remit the relevant taxes.

5.3 Payment Processor

Payment card data is processed exclusively by our PCI-DSS compliant payment processor. Card data is never stored on our servers.

6. Cancellation Policy

6.1 How to Cancel

You may cancel your subscription at any time via either of the following methods:

• Online (recommended): Account Settings → Subscription → Cancel Subscription
• Email: Send a cancellation request from your registered email to our customer service email

Cancellation takes effect immediately.

6.2 Effect of Cancellation

• The subscription remains active until the end of the current billing cycle.
• You will not be charged for subsequent billing cycles.
• Account data will be retained for 90 days after cancellation, then deleted in accordance with our Privacy Policy.

7. Refund Policy

7.1 General Policy

Due to the instant-delivery, intangible nature of our digital services, subscription fees are non-refundable in principle, with the following exceptions.

7.2 Refundable Situations

• Duplicate charges: Full refund for duplicate charges caused by billing errors.
• Verified service outage (over 72 hours): Pro-rated refund or extension for prolonged outages caused by us.
• Statutory rights: Refund matters are governed by applicable law.

7.3 How to Request a Refund

Send refund requests to our customer service email with your account email, transaction ID, and reason for the refund. We will confirm within 2 business days and process the refund to the original payment method within 5–10 business days.

7.4 Non-Refundable Items

• Subscription fees for billing periods already used (except as in Section 7.2).
• Annual subscription refund requests made more than 30 days after the initial purchase.
• Accounts closed due to violation of these Terms or the Acceptable Use Policy.

8. Billing Disputes

If you believe a charge is incorrect, please email our customer service before initiating a transaction dispute with your bank. We commit to responding within 3 business days and resolving confirmed billing errors within 5 business days.

9. AI Content & Intellectual Property

9.1 Output Ownership

Subject to your compliance with these Terms, AI-generated content produced from your inputs ("Output") is owned by you. You may use the Output for any lawful purpose within the scope permitted by Section 10.

9.2 Input License

By submitting content to the Service ("Input"), you grant AIProductPhoto a limited, non-exclusive license to use your Input solely to provide the Service to you. We will not use your Input to train AI models without your explicit consent.

9.3 Third-Party AI Model Dependency

The Service uses third-party AI model providers, including ByteDance Seedream, Nano Banana, ChatGPT Image, Minimax, Seedance, Gemini Omni, Veo, Kling, and others. Output may be influenced by these providers' models. We do not guarantee specific output quality and assume no liability for content generated by third-party models.

9.4 AI Output Accuracy

AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying Output before relying on it.

10. Acceptable Use Policy

10.1 Permitted Uses

You may use the Service only for lawful purposes consistent with these Terms, including personal productivity, business automation, and research and development activities.

10.2 Prohibited Uses

You agree not to use the Service to:

• Generate illegal, defamatory, harassing, or fraudulent content.
• Generate, disseminate, or assist in creating deepfake content, including AI-synthesized audio, video, or images impersonating real individuals or intended to mislead viewers about their origin or authenticity.
• Generate content involving the sexualization of minors or violating child protection laws.
• Create malware, phishing content, or cyberattack tools.
• Infringe any third party's intellectual property or privacy rights.
• Bypass or interfere with the Service's security features.
• Resell or sub-license access without prior written approval.
• Violate any applicable law, regulation, or card network rules.

10.3 AI-Specific Prohibitions

Given the AI-powered nature of the Service, you further agree not to:

• Use the Service's inputs, outputs, model responses, or any derivative data to train, fine-tune, benchmark, knowledge-distill, or otherwise develop any AI or machine learning model that directly or indirectly competes with the Service or AIProductPhoto's products.
• Systematically scrape, extract, or collect model outputs at scale for any purpose beyond your authorized personal use.
• Present AI-generated content as the work of a licensed human professional (e.g., a practicing doctor, lawyer, or financial advisor) in scenarios where doing so could cause harm.

11. Content Standards & Prohibited Categories

The Platform expressly prohibits the use of the Service to generate the following six categories of content:

• Pornographic / NSFW content.
• Violent / gory content.
• Hate speech.
• Child unsafe content (CSAM).
• Deepfakes / impersonation of others (Deepfake).
• Content infringing copyright / trademark.

Subsequent provisions detail the above categories and other violations.

11.1 Absolute Prohibition — Zero Tolerance

The following content will be acted upon immediately upon discovery, and we reserve the right to report it to the competent authorities:

• Child sexual exploitation content (CSAM) or any sexual content involving minors.
• Content promoting or facilitating terrorism, extremism, and mass violence.
• Technical guidance for manufacturing weapons of mass destruction.
• Content inciting genocide or ethnic hatred.
• Non-consensual deepfake (Deepfake) sexual content targeting real individuals.

11.2 Strict Restrictions — Subject to Review

• Adult content: Limited to compliant platforms that have completed age verification.
• Violent content: Must have a clear creative or educational context.
• Politically sensitive content: Content that may be misleading.
• Medical / legal / financial advice: Must comply with local regulatory requirements.

11.3 General Prohibited Conduct

• Generating or disseminating false information or rumors.
• Impersonating real individuals, brands, or institutions.
• Infringing intellectual property, portrait rights, or privacy rights.
• Deceiving users with AI content by claiming it is human-created.
• Mass generating spam or fraudulent content.
• Using jailbreak (Jailbreak) prompts to bypass platform safety mechanisms.

12. Content Moderation Mechanism

The Platform employs a multi-layered content safety review system combining automated real-time review + manual review + periodic sampling, covering the entire chain of user inputs, AI image / video generation, and anomalous account behavior. The Platform operates an independent gateway-level safety check and does not rely solely on the built-in safety capabilities of the underlying AI models.

12.1 Automated Review (Real-Time)

All user requests and AI-generated outputs (images, videos) are subject to real-time safety scanning.

1. Input Filtering (before generation) User-submitted prompt text, uploaded reference images / reference video assets are inspected; keyword interception, semantic intent recognition, and risk content assessment are performed. The system identifies various adversarial behaviors that attempt to bypass review, including prompt splitting, obfuscation, and segmented evasion of filters. Such evasion attempts are themselves platform violations. High-risk requests are blocked outright — the AI generation model is not invoked and no user credits are consumed.
2. In-Generation Dynamic Detection (for images and future AI video generation)
   • Image generation: intermediate samples during the generation process are safety-checked;
   • Video generation (a future platform feature): key frames during the rendering process undergo frame-level safety scanning; once a violating frame is identified, the video rendering task is terminated immediately.
3. Output Filtering (mandatory post-generation scan) Even if all user inputs pass review, the completed AI-generated image or full video is still subjected to another multimodal safety detection. Identified violating content is discarded and never returned to the end user.
4. Usage Behavior Analysis Monitoring of API call frequency, bulk submissions, concentrated batch generation, repeated violation triggers, and other anomalous account behaviors.
5. Safety Tools Used The platform's in-house safety filter comprises multiple layers including text semantic recognition, image / video multimodal risk identification, custom keyword blocklists, and known harmful media hash fingerprint matching.

12.2 Manual Review Process

1. All content flagged by automated review as borderline or suspected risk enters the manual review queue;
2. Content reported by users through the violation reporting channel is also routed to manual review;
3. Manual review records are fully retained: risk category, action taken, operator, and timestamp.

12.3 Periodic Sampling

The system samples real production traffic, including user prompts, uploaded original images / videos, and AI-generated output assets. Safety operations staff review automated review false-negative cases, iterate keyword rules, and adjust review thresholds to continuously improve filtering effectiveness.

12.4 Risk Levels L1–L4 and Action Rules

12.5 User Reporting Channel

Users may submit violation reports through the platform's customer support channel, or send report content to our customer service email; all reports are independently reviewed and reporter information is protected; malicious false reports are recorded and may result in account restrictions.

12.6 Violation Account Handling — Summary

The Platform may take the following actions for violations: block individual requests, remove violating assets, issue user warnings, impose feature or quota limits, and temporarily restrict accounts; in cases of serious or repeated violations, all service access is permanently terminated.

13. Data, Privacy & Security

Your use of the Service is governed by our Privacy Policy, published at https://aiproductphoto.net/privacy. Payment card data is processed exclusively by our PCI-DSS compliant payment processor and is not stored on our servers. Account data is retained for 90 days after cancellation, then deleted.

14. Disclaimers & Limitation of Liability

14.1 Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or accuracy of AI output.

14.2 AI-Generated Content Disclaimer

14.3 Limitation of Liability

To the maximum extent permitted by applicable law, AIProductPhoto shall not be liable for any indirect, incidental, consequential, or punitive damages.

15. Term & Termination

These Terms remain in effect for as long as you use the Service. We may suspend or terminate your account if you materially breach these Terms, engage in fraud, or as required by law. If we terminate the Service for reasons other than your breach, we will pro-rate a refund of the unused prepaid portion. You may delete your account at any time by contacting customer service.

16. Governing Law & Dispute Resolution

These Terms are governed by applicable laws. Before initiating formal proceedings, please first email our customer service to attempt an informal resolution.

17. General Terms

We may update these Terms from time to time. Material changes will be notified by email at least 14 days before the effective date. Continued use constitutes acceptance. If any provision is held invalid, the remaining provisions remain in full force. These Terms and the Privacy Policy constitute the entire agreement between you and AIProductPhoto.
